The processes, forms, administration and complications of a divorce procedure is not simple for the every day man. However, they are the pillars in our society that enable us to function in a country where almost everything we do needs a plethora of forms completed, certified and signed by several people.

We call on lawyers to be our guiding light in bureaucracy and champion our cause. We choose lawyers as representatives whom we believe will have our best interests in mind when acting on our behalf. Some fulfil more acknowledged and fantasized roles of prosecutors, defenders or class-action leaders, but we must not forget the lawyers who tend to us and guide us through the minefield of paperwork, requirements and processes.

Something like various payments made by either spouse to a house, life insurance for the benefit of a spouse and pension benefits can cause a few headaches and arguments when dividing who is legally entitled to what. Depending on the nature of the legal arrangement between spouses (i.e. the marital contract) various implications exist. In many cases nothing that was acquired during the marriage belongs to one spouse alone and an arrangement needs to be reached to divide this property equally. At the same time, lawyers enter the arena when there is a dispute over whether a partner to a marriage deserves or is entitled to some property. This can happen especially where one partner feels that the other should not benefit from the deterioration of a relationship which might have been the fault or intention of either party.

Divorce and property lawyers walk hand-in-hand since a divorce is likely to lead to the division of property acquired and/or shared by the separating partners. Where the divorce lawyer will take care of the process of legal separation the property lawyer will facilitate the procedure of the transfer of property. Partners who owned property in their own names and settle in such a way that property is transferred to the other require the services of both these lawyers. This is especially true for partners who jointly owned property and it has to be separated in proportion or according to legal standards.
